A screaming out !!!!


Today my peaceful mind got smashed out at work, our job is already hard and overwhelming, and the last thing we would ever need is this extra load of stress.

Here is the story, today's morning one police man came to my place of work, and asked a colleague of mine to go with him, he said there is a complaint against her, and she has to go with him, the beginning was few days back, when one sick baby boy died, during a major medical critical procedure, which was done in an attempt to save his life, to make the picture clearer, I have to mention that, death is a well known complication, for this life saving emergency procedure, the problem here is that, his parent couldn't accept this fact, and they want to accuse some body for their baby's lose.

I am not going to blame the parents here, and I am not going to discuss if they have the right to sue that doctor or not, and I am not going to defend my colleague, and try to convince you that she do her best to keep that baby alive.

I am here just to shout, to yell, to scream out: WAKE UP PEOPLE THIS IS NOT THE RIGHT WAY !!!

If every patient die, his family would make a complaint against the doctor who was on charge of him, in the nearest police department, and the police man came to arrests that doctor, we will definitely end up with empty hospitals.

There is a part of the Libyan law deal with these kind of cases, and any doctor accused, there is a respectful way to call him, and to investigate the suit with a scientific means, in the presence of consultants , who analyze the situation and with the judge, they can decide, if the suspected doctor was charged or not, I don't know why it is not applied in every case.

Our job is very critical, we deal with death on daily bases, and to be blamed for every single loss, and to be called as any criminal, (the difference is just they don't put a handcuffs in our hands), that will be an extra unbearable load at work atmosphere, and more than devastation to the doctor's spirit.

There should be a law, which can protect a doctor from being called to court in this unrespectful way, because he was doing his job, aiming to heal people, and save their lives and not attempting to kill them, then if they found he was accused, because of mistakes, ignorance, neglect or anything, justice will take place in the right way, and not the other way around; he is innocent till proved otherwise because that is the essence of his job.


By the way that wasn't the first time, for this to happen in my work field; and thanks for Allah it doesn't happen to me till now; but it seems that my threshold to tolerate these situations has reached its limit.

الي يسمعك تتكلمي يقول عليك في اوربا واطالبي بالعدالة ياودي فيقي وتلفتي حواليك..قانونا معبي بهلبة احكام وللعمل في هلبة أحكام ماتطبقش لأن الأغلبية مايعرفوهاش تري قوليلي منو...
حتي المحاميين في قوانيين موجودة وقديمة تحميكم أو تحمي أي موظف في دائرة عمله من الإعتقال والظلم..بس للأسف ماتلقاش حد عنده صورة من هالقانون بيحث يفيق النايمين والي تناسوه بحكم عدم تطبيقه


أحيانا مانقدروش نلوموا الأهل في ثورة غضبهم وسخطهم...بس لأن أسهل حاجة هي تمشي لمركز الشرطة وتقدم بلاغ ولو كان الطبيب بريء فإن الشرطة حاتتعاطف مع الأهل بحكم ماتلهم طفل ومستعدين يوروا الويل للدكتور مش لنهم شرطة وفاهمين القانون بس لأنهم متعاطفين وبس

اني اكثر حاجة ممكن نديرها لو طبيب غلط في وصف دواء ليا أو زادني سوء لعدم مهارته وفهمه لطرق العلاج عركة في الممر بس عركة راقيه شويه مش للضرب و الهزايب والسبان نقولوا مشادة كلاميه مستحيل نفكر نجيب شرطي باش ياخد دكتورة و دكتور بطريقة فيها تحقير لهالإنسان وبعدين

إنتم تبوا حماية حتي من المستشفي نفسه الي تشتغلوا فيه المفروض المستشفي يدافع عن أطبائه يطالب بالبحث عن اللوائح والقوانين القديمة الي تخاطبكم مش يسكتوا ويخلوا أهل الطبيب أو الطبيبه هم الي يدوروا في واسطه هني وغادي باش يحلوا المشكلة

المشكلة في السياسة المتخده مش اكثر

وربي يكون عونا كلنا مش انتكم بس

I am sorry to say but i am 100% with the family and every death should be shrewdly investigated and analyzed up to the smallest detail as we are talking about human life here, I encourage parents and families to take the law that is put there to protect "us" and when this is done any doctor will thick 10 times before he does anything and not be careless as a big majority of libyan doctors are (I know all the gory details as my father is a Consultant),

Now, looking at the other side, YES this will slow the process but we are looking for quality and NOT quantity and I agree with you that scientific investigations should be taken and the manner a doctor is sued should be more respectable but a I still support 110% the suing system as we Engineers are also sued for any mistake

LP, dont get me wrong I know there are some doc to work well but think about it

I hope you dont take any offence to what i have said

Salam Enlightened Spirit,
Wow, wow, wow, makes one wonder why anyone would ever go in the field of healing, other than of course it's their calling in life. However, the pressure is enormous---heightened by the emotions of those grieving can be nearly unbearable. I commend you and your fellow medical professionals that seek to do this profession as a living.

It's very hard for us as humans to remember or even accept (emotionally) that we are all only here for a certain number of days, hours, weeks, etc., and only Allah knows those the time.

Don't worry there is no offense at all,... but I am not sure that u really got my point.
I am more than totally agree with u that the parent have the right to understand the coz of death of their baby, and have the right to sue any body who shared the responsibility for their loss, any doctor should be sued for even very little tiny mistakes, how if it cost a life ...
but... what I am discussing here is the way that all this should be carried out, the way it is going now is totally wrong, my colleague didn't kill a baby in the street that is the only case when she should be sued this way, we are in the hospital, there is senior over us, my colleague was just a junior doctor, she wasn't alone taking the responsibility, just bcz she was the one who dealed with family and 1st one received the baby, the parent memorize her name and they put it in the court, and was asked at the court by ppl who don't know any thing about medicine, that is not the right way to do this, and definitely not by sending a police to a doctor and take him in front of his patients ...as I told u there is a system for this to be done through the hospital but it is 't applied in every case, and in the opposite side there is no law protect us from being sued by this stupid non respectful way.

yes it is unbearable sometimes, but what make us continue is when u succeed in saving a life of a baby, heal his pain, and bring a smile back to his and her mommy's face...when that happen all the loading burden is forgotten ...

It's very interesting and really very complicated.
just further to a_akak, rights of people( patients) should be guaranteed. But the way to conduct it is the point here. I think it should be through very organised and official chanels. Just arresting doctors at the work place by oridenary police officers is in my opinion Rubbish and reflects how primitive is our organisational and managmental work.

I think you got me wrong, as i said "I agree with you that scientific investigations should be taken and the manner a doctor is sued should be more respectable", so what i meant was that the way and procedure and steps to take the doc to be questioned should be respectable and in a dignified way and NOT in a publicly demoralizing way as in the end of the day we have to respect the human, now in the UK the consultant is responsible not the Registrar and not the senior Reg and defiantly not the intern/junior

Hello..U touched one of the most critical and unfortunate proplem we face as libyan doctors..
In all nations,patients have the right to sue,that's their right.Is this complaint is justified or not?this is very much the job of designated autority that is clear in all laws...The story u told is dangerous and sensitive..Again,i'm a physician and i believe in the right of patients and patients' families to know what went wrong,but not like this...
By the way,there've been regulations in Libya(as surprising as this is) about this particular situatin,and i will change to arabic now:
قامت نقابة الأطباء(أجل لدينا نقابة أطباء تجد بعض الوقت للتفكير في مشاكلنا وسط مشاغلها بتوفير سيارات باهظة الثمن و أراضي لا يقدر عليها الا من رحم ربي),كنت أقول بأن نقابة الأطباء قد قامت بتنظيم طريقة استدعاء الأطباء في الحالات المماثلة بحيث لا يحق لأي ممثل للقانون أن يقوم بالقبض على أي طبيب متهم بسوء ممارسة المهنة بدون الرجوع الى النقابة,و يتم الاستدعاء عن طريقهم فقط..و أي مخالفة لهذا,أظنها تعطي الطبيب الحق في مقاضاة المتجاوزين...لم أتعرض لموقف مماثل و الحمد لله,لكن شخصا ما من النقابة(أظن في فترة استراحة من تسويق سيارات النقابة)أبلغني بهذا,أو لعلي سمعته في مؤتمر ما؟لست أذكر
أنصح صديقتك بالاستفسار و التأكد,و اذا وجدت الأمر مناسبا,انصحها بشدة بمقاضاة رجال الشرطة هؤلاء
بالنسبة لموضوع الطفل,أرجو من الله أن يصبر والديه ويتغمده بالرحمة...

being a libyan doctor, dealing with libyan patients in a libyan hospital. well, you need all the wisdom on earth girl. cause sure there's not so much to change.

that was a very grey area topic ,i realy feel sorry of the lost of live, wich i think it was gods act, the family got every right to be upset , but the way the doctor been treated i think it was out of order, how come a policman just walk into a hospital and arest a doctor?iam sure it should be a court order issued in those cases, its sad to think the doctor did not try his or her best to rescue the life .but lately alot of people putting the blame on libyan doctors in every case.common sense has to prevail, i agree with BC ,iam sure all dotors did study alot regarding the law aspect ,
but in a vital cases only one decision can be taken to save a life,she tried her upmost to save the life,thats goes with out a shadow of a thinking.sure it was a internal hospital invistigation carried out to the case,lets just all wish for a peaceful ending to all ibnshallah

yes there is a regulation, but whay it is not applied in every case, is it coz there is 't a supporting law or what???
they start the suit in an ordinary way they call the suspected doctor as any accuser, and later they start the scintific investigation, and usually end up that the doctor is innocent, but بعد مايتبهذل الدكتور وبعد مايكرهوه في عيشته ومش لازم نحكي كيف تولى معاملته مع الناس بعد هالتجربة المريرة ان شاء الله مايشوفها حد.

the catastrophic thing is that there is an order from the court to call that doctor, without any previous announcement, without any previous invetigations if that complaint was right or wrong really depressing...

I am very sorry that things are this way. I find it damn wrong.
In my country, we have the opposite extreme. Before undergoing a medical procedure, you have to sign a form that you accept all risks associated with it. As you guess, it makes it rather difficult for the patient to defend his right in cases of malpractice. Still, I think this system is better than regarding the doctor as a wizard able and obliged to provide any desirable result, and if he fails, regarding this as a crime until/unless proven otherwise.
In one of my posts about the trial of Bulgarian medics in Libya, I tries to make a point why it is a bad idea to scapegoat ordinary medics when things in a hospital go wrong:

At one moment during the trial, another Bulgarian doctor in Libya was also in trouble. He couldn't save the life of a woman who was brought to him with multiple injuries. The police were interested in him but, happily, he wasn't charged.
I disagree with A_Akak. His priority is to obtain justice, while mine is to make the system work as well as it can.
When something, somewhere goes wrong, people always think about the rod and almost never about the carrot. However, "all rods and no carrots" is the principle of the slave labour. History has proved it inefficient. And it is especially inefficient when the "slave" is actually free to walk away.
At my workplace, we are overworked and underpaid and this makes some colleagues leave. And what measures do the bosses take? Increase salaries? No, they order young assistants willing to complete a residency to sign that they will stay at our University for at least 5 years after completing the residency. A younger colleague told me, "This stupid paper, which wouldn't hold in any court, was the last straw for me. I am leaving." He moved to a psychiatric ward for insane criminals, preferring them to our buraucrats trying to make him crazy.
If doctors are harassed and severely punished for each supposed mistake, more and more good professionals will decide to leave the craft, the country or both. And then the same patients who so eagerly call the police will wonder, why we have a shortage of medics and why of those we have, so many are incompetent and careless?
